Description
Senior Trusts & Estates Attorney — Flexible Hybrid
McCabe, Coleman, Ventosa & Patterson PLLC | Hudson Valley, New York
We are seeking an experienced New York trusts and estates attorney to take primary responsibility for matters in our growing practice. There are no fixed office days. You may work remotely, and office space is available in both Poughkeepsie and Wappingers if you prefer to work in an office. In-person attendance is required when scheduled for document signings and Surrogate’s Court appearances.
Our managing partner conducts initial consultations and develops client relationships. Once a matter is retained, you will own the legal work: confirm the planning approach, identify issues requiring further discussion, draft and revise documents, explain plans to clients, and carry matters through completion. You will also oversee estate administration matters and direct the work of an experienced contract paralegal. Client origination and initial sales consultations are not required.
Our most important planning work involves clients with taxable estates, business owners, and clients seeking Medicaid asset protection. We need an attorney with substantial hands-on experience in these areas who can exercise independent judgment while collaborating closely with the managing partner.
Responsibilities include:
Designing and drafting estate plans, including sophisticated revocable and irrevocable trusts;
Advising on New York and federal estate tax planning issues;
Drafting Medicaid asset protection trusts and related planning documents;
Preparing and coordinating business formation and succession documents, including LLC operating agreements and buy-sell provisions;
Conducting client document-review meetings and handling revisions;
Managing probate and estate administration matters, including supervising paralegal work, communicating with fiduciaries, and handling Surrogate’s Court appearances; and
Conducting document signings when scheduled.
Qualifications:
Active admission and good standing in New York;
Substantial experience independently handling trusts and estates matters for clients with taxable estates;
Meaningful New York Medicaid planning and trust-drafting experience;
Experience with business-owner planning and entity documents;
Strong client communication, drafting, and file-management skills; and
Ability to manage matters independently while keeping the team informed of material decisions and deadlines.
Compensation: $100,000 annual base salary plus a defined production bonus. The bonus equals 15% of annual collected flat fees above $200,000 on matters under your primary responsibility, plus 15% of collected fees attributable to your own hourly work. An additional origination bonus will be paid on all files originated by you, although there is no requirement or expectation to originate business.
To apply, please submit a résumé and a brief description (bullet point list is fine) of the taxable-estate, Medicaid-planning, and business-owner matters you have personally handled. Please do not submit confidential client materials.
